Terms of Reference for Hiring a Consultant to Develop Collective Bargaining Tools

Background:
The Workers Resource Centre (WRC) is a collaborative platform established by the National Coordination Committee for Workers Education (NCCWE) and the IndustriALL Bangladesh Council (IBC). Formed in 2017 and launched in 2018, the WRC aims to enhance workers' rights in Bangladesh.
The Workers Resource Centre (WRC) is committed to advancing the rights and welfare of workers in Bangladesh, particularly in the garment sector. Recognizing the importance of collective bargaining in securing fair working conditions and protecting workers' rights, WRC aims to develop a comprehensive Collective Bargaining Tools tailored to the specific needs of trade unions operating in the garment industry.
Brief Description of the Proposed Project:
The Name of the project : SUPPORT FOR EFFECTIVE AND INCLUSIVE TRADE UNIONS IN BANGLADESH
The proposed project aims to address critical challenges faced by trade unions in Bangladesh, including issues related to union registration, low union density, and limited organizational capacity. Despite existing registration, many unions struggle to function effectively due to capacity constraints. However, strengthening trade unions can significantly improve workers' rights, organizational effectiveness, and collective bargaining power. By empowering trade unions to better organize, prepare Charter of Demands (COD), negotiate collectively, and resolve labor disputes, the project aims to enhance working conditions, workplace safety, and overall productivity in the garment sector. Recognizing the importance of gender equality within trade union structures, the project will also focus on analyzing and addressing disparities in women's representation in decision-making bodies. Engaging youth and women committees will be crucial in identifying and overcoming factors contributing to these disparities, ultimately fostering a more inclusive and democratic trade union movement in Bangladesh.
Objectives:
Develop a user-friendly and practical Collective Bargaining Tools to empower trade unions in negotiating with employers and advocating for better working conditions.
Enhance the capacity of trade union representatives to effectively utilize the Collective Bargaining Toolkit and engage in constructive dialogue with employers.
Foster collaboration and trust between trade unions, workers, and employers to promote a conducive environment for collective bargaining and dispute resolution.
Scope of Work:
Conduct a comprehensive needs assessment to identify the specific challenges and gaps in collective bargaining capacity among trade unions in the garment sector.
To prepare guideline for Charter of Demands (COD)
Review existing collective bargaining frameworks and tools, both domestically and internationally, to inform the development of the Toolkit.
Design and develop the Collective Bargaining Tools, incorporating best practices, practical guidelines, templates, and case studies relevant to the garment industry context in Bangladesh.
Pilot test the Toolkit with select trade unions to gather feedback on usability, effectiveness, and relevance.
Refine and finalize the Tools based on feedback received during the pilot phase, ensuring that it meets the needs and requirements of trade unions and workers.
Provide training and capacity building sessions for trade union representatives on how to effectively utilize the Collective Bargaining Toolkit in their negotiations with employers.
Deliverables:
To set basics of registering Trade Unions in any enterprise
To set guidelines to produce Charter of Demands (COD)
To make Comprehensive Collective Bargaining Toolkit, including practical guidelines, templates, and case studies.
To have pilot test report with evaluation findings and recommendations for refinement.
To finalize Collective Bargaining Tools and training materials, incorporating feedback from the pilot phase.
Timeline:
The deadline for submitting the Expression of Interest (EOI) is June 23, 2024.
The project is expected to be completed within, with key milestones including:
Needs assessment: July 1, 2024
Tools development: July 15, 2024
Pilot testing and refinement: July 20, 2024
Finalization of materials: July 25, 2024
Stakeholder Engagement:
Collaborate with Trade Unions, workers' organizations, government agencies, and relevant stakeholders throughout the project lifecycle.
Regular communication and consultation to ensure alignment with stakeholders' needs and priorities.
Budget:
A detailed budget proposal will be developed by the consultant in consultation with stakeholders, considering the resources required for conducting the needs assessment, tools development, pilot testing, and finalization of materials. Technical and financial proposal must be submitted for the final selection process.
Monitoring and Evaluation:
Consultant will establish mechanisms for monitoring the implementation and impact of the Collective Bargaining Toolkit.
Consultant will conduct regular evaluations to assess the effectiveness of the training program and Toolkit in enhancing trade unions' capacity and improving workers' rights.
Use feedback from stakeholders to inform continuous improvement and adaptation of the Toolkit and training materials.
Reporting:
The consultant will summarize a final report to highlight the outcomes and lessons learned from the Collective Bargaining Tools development process. Additionally, the consultant is reportable to the Program Manager of WRC for his CBA tool development.
Ethical Considerations:
Consultant will ensure that all activities are conducted in accordance with ethical principles, respecting the rights and dignity of workers and stakeholders involved.
Promote transparency, accountability, and inclusivity throughout the project.
