Human Rights Based Approach to Humanitarian Action

Humanitarian crises -- including man-made conflicts, natural disasters and pandemics -- often result in or exacerbate human rights concerns. In addition, deteriorating human rights situations may trigger crises and increase humanitarian needs of affected populations (www.ohchr.org)

With a view to transcending purely philanthropic or political approaches to disaster relief overlooking the entitlement of victims of a catastrophe to be assisted, humanitarian assistance from a human rights perspective becomes crucial. Humanitarian aid operations are presented as the result of the interaction between the human rights of people affected by disasters and the corresponding governmental obligations. A distinction is made between disaster relief in which the relevant rights are the ones to life, food, health and medical services, water, adequate housing and clothing, and a prospective regime in which a human right to receive humanitarian assistance is recognized by the international community. The juxtaposition of the two regimes highlights the differences in the levels of protection they afford. It also proves that, in both cases, the adoption of a human rights-based approach safeguards affected people by empowering them to challenge governmental decisions to refuse international aid and by placing under international scrutiny the measures taken by sovereign States to protect their populations in the aftermath of catastrophes (source www.brill.com)

PURPOSE OF THE CONSULTANCY

ACT Forum is a consortium of various humanitarian and development agencies with ICCO Cooperation as the Coordinator of the Forum in Bangladesh. The ACT agency members are responding to the world largest camp settlement crisis in Coxś Bazar focusing on both the Rohingyaś as well as the host community. Our work collectively focuses on the Rohingya as well as the host communities with two overarching principles viz, self reliance for the refugees and social cohesion between the host communities and the refugees.

We apply a human rights-based approach to humanitarian action, securing the participation of the affected population in preparedness, response and recovery efforts. We aim at empowering people to claim their rights and strengthening the capacities and accountability of duty-bearers to meet their legal obligations under international human rights and humanitarian laws. We try to include the most vulnerable and excluded from humanitarian protection and assistance, reduce discrimination and politicisation in the distribution of aid, and suggest measures to prevent violations and their recurrence.

Based on the internal discussion between the team members, we realise there is a need for capacity building of our team on Human Rights Based Approach to Humanitarian Actions

Scope of work:

• Assess and understand various frameworks for Human Rights Based Approach to Humanitarian Action
• Carry out the capacity needs assessment of the ACT Alliance team members on Human Rights Based Approach to Humanitarian Assistance.   
• Design a two days training module in consultation with the ACT team members.
• Conduct two days training for the team in Cox’s Bazar
• Prepare and submit the training evaluation and quality checklist report

EXPECTED DELIVERABLES 

• A framework on Human Rights Based Approach to Humanitarian Action
• A short report on Training Needs Assessment (TNA) for the participants
• A training module on Human Rights Based Approach to Humanitarian Action
• Delivery of a two days training (tentatively 2nd week of June 2021)
• All training materials including the presentations
• A short report on the training including the post evaluation of the training as mentioned above

REQUIRED EXPERIENCE OF CONSULTING Firm/Individual(S) 

• Applicant(s) must have a solid and proven track record on similar kind of assignments
• Experience of similar work at Cox’s bazar region will be given preference
• Excellent training facilitation skill and knowledge

SUBMISSION OF PROPOSAL
Interested consultant(s)/consulting firms must submit the technical and financial proposals.
The proposal should include:

Technical Proposal:

• CV of the individual or team members
• Introduction letter including a brief overview of the assignment as understood by the bidder
• Methodological outline or technical proposal for delivery in detail
• Preliminary detailed itemized work plan – including timeframes for submissions of all deliverables. A smart work plan for possible work that can be performed in the current COVID-19 pandemic environment is also desirable as contingency.
• Include the reference on similar kind of assignments in the cox bazar context

Financial proposal

• Detailed itemized budget and price justification including VAT/TAX calculation 
• Annexes: if Any documents, such as work samples, or other information, which the consultant feels will assist proposal review team in evaluating the proposal 
• Formal evidence or proof of registered status of consultancy firm, TIN certificate etc

• Team composition: 15%
• Prior experience of working on the Rohingya Crisis: 20%
