Reporting to: Child Protection Specialist, UNICEF, Bangladesh and Project Director, Strengthening Capacity of Judicial System for Child Protection in Bangladesh, MoLJPA

A. Purpose:

The assignment is to provide the Ministry of Law, Justice and Parliamentary Affairs and UNICEF Bangladesh with technical assistance in relation to the implementation of the activities of the project title “Strengthening Capacity of Judicial System for Child Protection in Bangladesh” and Annual Workplan, particularly to ensure the followings:

  • Play an active role in achieving objectives, strengthening process and progress monitoring of the project.
  • Actively engage in formulating project documents, strategies, suggest innovations for improving quality of delivering the activities.
  • Perform knowledge management activities such as capturing, documenting, and sharing project learning.
  • Perform planning, budgeting, developing and implementing the activities in line with goal and objectives of the project.
  • Monitor progress, process and quality of project interventions and take necessary corrective measures throughout the project cycle to support project management team.

B. Background:

UN Agency Bangladesh has been providing technical assistance to Law and Justice division, Ministry of Law, Justice and Parliamentary Affairs (MoLJPA) to ensure the rights to protection of children in conflict and contact with the law through its project title “Strengthening Capacity of Judicial System for Child Protection”. The goal of the project is to develop improved and equitable prevention of and response to violence, abuse, exploitation and neglect of children, with particular investments in the targeted areas corresponding to UN Agency Country Program: 2017-2020. The purposes of the project are

  • To establish Children’s Court and make functional.
  • To enhance knowledge and skills along with instrument to support the implementation of Children Act 2013 and related laws and rules for strengthening juvenile justice system and legal support.
  • To strengthen institutional capacity and develop multi- disciplinary and sectoral training module for training to relevant stakeholders on Children Act 2013.
  • To establish coordination and reporting mechanism among Judicial Officers, Law Enforcement Agencies and Probation Officers for effective implementation of Children Act 2013.

Meanwhile, UN Agency Bangladesh has been entered to a new country programme starting from 2022-2026. One of the major areas of Child Protection Programme in Bangladesh is to strengthen the legal and policy framework designed to support the implementation of multisectoral coordinated plans of action to ensure access to justice and protection for children in contact and conflict with the law. Law and Justice Division, Ministry of Law, Justice and Parliamentary Affairs (MoLJPA) and Public Security Division of Ministry of Home Affairs (MoHA) are the two key ministries with the responsibility to implement the Children Act 2013 along with Department of Social Services (DSS) of Ministry of Social Welfare (MoSW). Moreover, other actors like Police Head Quarter (PHQ), Bangladesh Supreme Court, Legislative and Parliamentary Affairs Division of MoLJPA, National Human Rights Commission (NHRC) and National Parliament are the other stakeholders who have been directly and indirectly contributing to shaping the justice system in Bangladesh. This sector has significant achievements in the past five years and a major shift in the approach and incorporation of innovation in the implementation of the justice for children programme provoked a unique dimension of administering justice for children. Therefore, building up on the impacts of the implementation of the interventions made by UN Agency Bangladesh with the Government counterparts in last country programme, it has become crucial to re-strategize the approach and develop a mechanism for the effective utilization of prior UN Agency investments so that planned results for this country programme are achieved.

Therefore, it is crucial to provide the technical assistance of the consultant while the project is working with multiple ministries, PHQ and the Supreme Court. Support also needs to be given to the CP section and the ministries to achieve the planned results the RAWP of 2022-23 in the area of ending violence against children and ensuring justice for children.

Thus, a full-time consultant who is familiar with planning, management, implementation and monitoring of the project are needed to ensure the timeliness and quality of the implementation of the RAWP 2022-2023 with the ministries and Supreme Court.

C. Deliverables:

  • Support and facilitate the process of establishing 8 pilot Children’s Courts in eight divisions with adequate equipment’s and logistics as per Children Act 2013 and introducing video conferencing between Children’s Court, Shishu Unnayan Kendra (SUK) and Safe homes.
  • Assist in strengthening the Children’s Court and legal aid for children in conflict with the law.
  • Assist in organising sectoral and multisectoral training on Children Act 2013 and Justice for Children.
  • Assist in strengthening capacity of National Academy for Social Services (NASS) and 6 Regional Training Centre (RTC) enabling to organize and conduct training for the Probation Officer’s on Children Act 2013 and Rules.
  • Assist and coordinate in developing costed implementation plan related to Law and Justice, MoLJPA on the Children Act 2013 and its Rules with monitoring framework and clear coordination and accountability lines among ministries.
  • Assist in establishing coordination and reporting mechanism among Judicial Officers, Law Enforcement Agencies and Probation Officers for effective implementation of Children Act 2013.
  • Assist in strengthening capacity of District Legal Aid Committee (DLAC) and network of Lawyers for capacity development to provide pro-bono legal aid to expedite trials of the children and follow up.
  • Organize the meeting of Project Implementation Committee (PIC) and Project Steering Committe (PSC)
  • Support in day to day programme related documentation, reporting and updates.

D. Consultancy Cost:

  • The consultants will get BDT 180,000.00 per month for 12 months as a consolidated package. If the consultants are required to travel outside their duty station, prior approval will be required. Travel and DSA will be reimbursed as per project policy.
  • Consultant will be based in the project office with frequent field visit to intervention sites/districts as required and report to Child Protection Specialist and Project Director.
  • Monthly activity and as per deliverables will be submitted to the supervisor and submit plan for the next months. 
  • UN Agency will not provide consultant with office space.
  • Stationery, communication and other office equipment costs will have to be borne by the project;
  • Consultant will be responsible to pay all taxes as per government rules and regulations.E-Zone will make statutory deductions towards income tax as per government rules and regulations.

E. Profile Requirements Qualification Skills:

Education:

  • Advanced university degree in Law, Social Science, Development Studies or a related field

Work Experience:

  • Minimum 5 years of relevant professional work experience in programme management and monitoring.
  • Knowledge of the latest development of child protection, justice for children and legal reforms and international standards
  • Experience in coordination with government counterparts and civil society organizations
  • Prior working experience with international organizations and UN is an asset
  • Experience in working with the government and familiar with the government procedure
  • Excellent communication and presentation skills

Language requirements:
Excellent command of written and spoken English & Bangla.
