A. Purpose:
The assignment is to provide the Ministry of Law, Justice and Parliamentary Affairs, Ministry of Home Affairs, Bangladesh Supreme Court, Department of Social Services and UN Agency with technical assistance in relation to the management and implementation of annual workplans signed, particularly to ensure the followings:
- Assist in undertaking Internal legal situation review, technical and legal analysis of different laws, rules, regulations and judgements and guidance in legislative reform process.
- Assist in the advocacy to government counterparts in undertaking different process-oriented steps in terms of the implementation of the Children Act 2013 including expediting the amendment of the Children Act, enactment of the Rules and develop the Costed Plan of Action to implement the law.
- Assist to plan, coordinate and the management of the capacity development plan of the Children Act and roll out of the multidisciplinary and sectoral training of the Children Act 2013 in UN Agency supported Districts.
- Plan and organise sectoral consultation with the stakeholders to promote the practice of diversion and non-custodial measures according to the law in cooperation of the Supreme Court and the relevent ministries.
- Support to the establishment of Child Friendly Courts including virtual courts and police help desk for children and support in establishing the standards and guidance regarding practicing child friendly procedure.
- Support in advocating and sensitization for the diversion and noncustodial measures to be practiced by the police, probation and judges and support in developing monitoring plan by zone offices.
- Technical support to the Law and Justice Division to manage, guide and orient the J4C Field coordinator and programme officers and Finance officer on programme implimentation , follow up and reporting.
- Assist in strengthening national information management system on justice for children and in undertaking and follow up on taking any legal research,
- Assist and technical guidence for developing the TAPP with the government, develop technical guidence notes, managment guidelines for Justice sector workforce, curriculum development.
B. Background:
UN Agency Bangladesh has been entered to a new country programme starting from 2022-2026. One of the major areas of Child Protection Programme in Bangladesh is to strengthen the legal and policy framework designed to support the implementation of multisectoral coordinated plans of action to ensure access to justice and protection for children in contact and conflict with the law. Law and Justice Division, Ministry of Law, Justice and Parliamentary Affairs (MoLJPA) and Public Security Division of Ministry of Home Affairs (MoHA) are the two key ministries with the responsibility to implement the Children Act 2013 along with Department of Social Services (DSS) of Ministry of Social Welfare (MoSW). Moreover, other actors like Police Head Quarter (PHQ), Bangladesh Supreme Court, Legislative and Parliamentary Affairs Division of MoLJPA, National Human Rights Commission (NHRC) and National Parliament are the other stakeholders who have been directly and indirectly contributing to shaping the justice system in Bangladesh. This sector has significant achievements in the past five years and a major shift in the approach and incorporation of innovation in the implementation of the justice for children programme provoked a unique dimension of administering justice for children. Special focus will be given in developing families and communities skills and resilience in playing their role to protect children, as well as the development of a multi-ministerial and community-based protection system to ensure all children including adolescents have access to protection services. Investment will be made to strengthen the capacity and institutional development, promote stronger multisectoral planning and coordination and the community-based system of preventing harm to children before it occurs. Therefore, building up on the impacts of the implementation of the interventions made by UN Agency with the Government counterparts in last country programme, it has become crucial to re-strategize the approach and develop a mechanism for the effective utilization of prior UN Agency investments so that planned results for this country programme are achieved. More specifically the Justice for children pillar seeks broadly to:
- Establish a comprehensive legislative framework for children in line with the Convention on the Rights of the Child, including the establishment of a child-sensitive juvenile justice system following undertaking of different, research, mapping and assessments.
- Strengthen the relevant institutions judiciary, social services and law enforcement agencies by developing the infrastructure and the capacity of duty bearers to ensure enforcement of legislation particularly the Children Act 2013 which offers better protection for children in conflict and contact with the law.
- Undertake community-based programmatic interventions to prevent juvenile delinquency and to encourage diversion mechanisms and alternative measures for children in conflict with the law; and
- Develop and enhance data collection and knowledge management by developing digitalized monitoring system and conducting case studies and documentations.
Strengthening the capacity of government duty bearers and civil society actors who are engaged in implementing the Justice for children in Bangladesh according to the new revision of the Children Act 2013 (amended in 2018) has become a paramount consideration. Moreover, the infrastructure and supplies that have been supported will need to be resettled with the right positioning in line with the newly amended Children Act 2013. Also, structured advocacy to expedite the enactment of the Rules of the Children Act 2013 as well as the development of a Government Costed Action plan. Support will be provided to the realistic enforcement of the Laws and Rules by the duty bearers and in accordance with the Costed Plan of Action towards effectively benefit the children in conflict and contact with the law.
Therefore, it is crucial to continue the technical assistance of the consultant while the section is working with multiple ministries, PHQ and the Supreme Court. Support also needs to be given to the CP section and the ministries to enhance its capacity to achieve the planned results the RAWP of 2022-23 in the area of ending violence against children and ensuring justice for children.
Thus, a full-time consultant who is familiar with legal system of Bangladesh, networks and coordination with the government and technical support in developing the laws, rules and legal reforms are needed to ensure the timeliness and quality of the implementation of the RAWP 2023 with the ministries and Supreme Court.
C. Deliverables:
- Facilitate and liaise between the ministries, PHQ and the supreme court to coordinating the implementation of the activities of the RAWP. Participate and follow up with the SCSCCR meeting and other coordination meeting decisions with the relevant agencies.
- Assist in drafting of Laws, Rules, Policies and Action Plans required by the programme including policy briefings and guidelines and SoPs.
- Technical assistance in scaling up of the good practices in Children Courts and Police stations and Probation officers regarding practice of diversion and non-custodial measures.
- Technical support to the Law and Justice Division to manage, guide and orient the J4C Field coordinator and programme officers and Finance officer on programme implimentation , follow up and reporting.
- Support in conducting Sectoral /multi-sectoral training on Children Act 2013 and Access to Justice held in maintaining quality and standards and compiled reports and follow up practice at the police stations and courts.
- Provide technical support to the Law Departments of Universities to develop curriculum on Children Act 2013 Support in collecting and managing data and evidence generation and undertaking legal researches.

D. Consultancy Cost:
The consultants will get BDT 4,00,000.00 per month for 12 months as a consolidated package which includes lumpsum travel cost in duty station. If the consultants are required to travel outside their duty station, prior approval will be required. Travel and DSA will be reimbursed as per UN Agency policy.
E. Administrative Issues:
- Consultant will be located in Dhaka with frequent field visit to intervention sites/districts as required and report to Child Protection Specialist.
- 2 Quarterly activity plan and as per deliverables will be submitted to the supervisor and submit plan for the next quarter.
- UN Agency will not provide consultant with office space.
- Stationery, communication, and other office equipment costs will have to be borne by the Consultant.
- Consultant will be responsible to pay all taxes as per government rules and regulations. E-Zone will make statutory deductions towards income tax as per government rules and regulations.
F. Profile Requirements Qualification Skills:
Education:
- Advanced university degree in Law, Social Science, Development Studies, or a related field
Work Experience:
- Minimum 10 years of relevant professional work experience in programme management and monitoring at field level.
- Knowledge of the latest development of child protection, justice for children and legal reforms and international standards
- Experience in cooperation with government counterparts and civil society organizations
- Prior working experience with international organizations is an asset
- Excellent communication and presentation skills
Language requirements:
- Excellent command of written and spoken English & Bangla.
