Terms and Conditions

Delivery Instructions:

Seeds should be delivered at para level through seed distribution point among SAPLING participants by March 08 , 2018. An updated list of Seed Distribution Points (SDPs) and Seed Distribution Plan will be shared in due course (attached is a sample SDP list). The Upazila wise Seed Distribution Points (SDPs) tentatively are as follows:

  • Lama Upazila – 173 SDPs;
  • Ruma Upazila – 35 SDPs;
  • Bandarban Sadar Upazila – 89 SDPs;
  • Rowangchari Upazila – 35 SDPs;
  • Thanchi Upazila – 37 SDPs;
  • Total – 368 SDPs (Tentative) – Number of SDPs may increase or decrease.

The vendor has to deliver seeds in the remote area/Para of the 5 upazilas (Lama, Ruma, Bandarban Sadar, Thanchi, Rowangchari) of Bandarban district using local-level input sellers. The selected vendor will submit a list of dealer/sub dealer/retailer/representatives/entrepreneurs who will be responsible for direct distribution of seed to participants with the quote. SAPLING will provide muster rolls of the participants to the vendor or will ensure at the SDPs as per the Seed Distribution Plan. The selected vendor’s representatives will distribute the seed to the participants of SAPLING. During distribution, vendor’s representatives will take signature/thumb print of recipients in muster roll with assistance of SAPLING after providing the allocated quantity to the participants.

The vendor need to make seed packets as per each type unit quantity and seed must be delivered in small packet with 7 & 9 varieties in 1 large packet for individual participants. ( Total participants- 44,000 of 5 Upazila’s of Bandarban district)  Details of seed packet and package has been attached.

Seeds must be delivered to respective SDP by the vendor’s own cost (distribution/carrying cost must be included), and distribute directly to eligible recipients via SAPLING supplied muster rolls which will be witnessed by SAPLING staff.

The Distribution Plan will be prepared by the SAPLING staff and shared with vendor. While preparing plan, SAPLING staff may consult with the vendor, if necessary. In case of natural calamity or any unforeseen unavoidable circumstance, SAPLING may decide to postpone a distribution by consulting with vendor. In this case, vendor will distribute in the rescheduled date.

70% of payment will be made after completion of seed distribution as per criteria. Rest 30% of payment will be withheld until confirmation from SAPLING participants for receiving report.

Quotation must include the following:

  • Quote shall be marked with RFQ for the supply of summer vegetable seeds in SAPLING Project;
  • Please provide valid Company Trade License, TIN and VAT Registration documents;
  • Please mention the variety of the seeds offered;
  • Please mention the country of origin for each type of seeds;
  • Detailed description of the quoted items and be specified;
  • Local level distribution costs should be included in quote;
  • Detailed information on germinations;
  • Quotation must be submitted in BDT inclusive of all taxes (seeds are VAT exempted);
  • Mention 45 days or more validity of your Quotation/Proposal;
  • During contact period all unit prices agreed upon are considered final;
  • Statement that vendor will adhere to HKI’s terms and conditions;
  • Affirmation of germination rate of at least 80%
  • Delivery of afore mentioned seeds by 08 March 2018 to SAPLING participants.

Specifications and eligibility criteria:

  • Offers will be evaluated based on their responsiveness to specifications.
  • Eligibility will be based on valid vendor registration and an affirmation that vendor will obtain either a Seed Certification Label officially recognized by the Government of Bangladesh OR a Seed Grower's Declaration of Quality. The Declaration of Quality must, where possible, be based on sampling and testing by a recognized seed laboratory, and must state as much of the following information as applicable and possible:

(1) Crop and variety
(2) Where the seed was grown (country)
(3) Seed lot number
(4) Incidence of weed seeds
(5) Percentage of inert matter
(6) Germination and hard seed
(7) Names and rates of noxious weed-seed occurrence (which must conform to laws of the country where the seeds are to be used)
(8) Month/year in which purity and germination tests were completed
(9) If seed was treated, chemicals with which treated and cautionary statement, if advisable
(10) Where, and by whom the seed was tested, i.e., laboratory, etc.

The Seed Grower's Declaration of Quality must identify the vendor’s transaction by date and quantity, and identify the lot involved. The Declaration must be dated and signed by an individual authorized to bind the grower and shall be issued to the Supplier.

Submission Deadline:

  • The quote must be submitted to HKI no later than 27 February 2018;
  • Quotations submitted after the deadline will not be considered;

Submission Method:

  • If you choose to submit a hard copy, submit your quote on company letterhead duly signed and stamped by an authorized person of the company and delivered to the HKI Office (House-10E, Road-82, Gulshan-2, Dhaka-1212) and addressed to Procurement Officer;
  • If you choose to send your quote by e-mail you must sign, stamp, scan and send the quote as an attachment in PDF format to Bangladesh.procurement@hki.org.

Others

  • Issuance of this RFQ does not constitute an award commitment on the part of the HKI, nor does it commit HKI to pay for costs incurred in the preparation and submission of a bid;
  • HKI may contact bidders to confirm contact person, address, bid amount and to confirm that the bid was submitted for this solicitation;
  • False Statements in the Bid: Bidders must provide full, accurate and complete information as required by this solicitation and its attachments; HKI reserves the right to terminate any contract for statements found to be false as determined by HKI and Vendor agrees to provide appropriate refund for defective materials;
  • Conflict of Interest Disclosure: Bidders must provide disclosure of any past, present or future relationships with any parties associated with the issuance, review or management of this solicitation and anticipated award.  Failure to provide full and open disclosure may result in HKI having to re-evaluate selection of a potential Bidder;
  • Right to Select/Reject: HKI reserves the right to select and negotiate with those firms it determines, in its sole discretion, to be qualified for competitive proposals and to terminate negotiations without incurring any liability.  HKI also reserves the right to reject any or all proposals received without explanation;
  • Reserved rights: All RFP responses become the property of HKI and HKI reserves the right in its sole discretion to:
  • To disqualify any offer based on Bidder’s failure to follow solicitation instructions;
  • To waive any deviations by Bidder from the requirements of this solicitation that in HKI's opinion are considered not to be material defects requiring rejection or disqualification; or where such a waiver will promote increased competition;
  • Extend the time for submission of all RFQ responses after notification to all Bidders;
  • Terminate or modify the RFQ process at any time and re-issue the RFQ to whomever HKI deems appropriate;
  • Issue an award based on the initial evaluation of offers without discussion;
  • Award only part of the activities in the solicitation or issue multiple awards based on solicitation activities.

Contract Provisions for Non-Federal Entity Contracts Under Federal Awards

In addition to other provisions required by the Federal agency or non-Federal entity, all contracts made by the non-Federal entity under the Federal award must contain provisions covering the following, as applicable.

  • All contracts in excess of $10,000 must address termination for cause and for convenience by the non-Federal entity including the manner by which it will be effected and the basis for settlement.
  • Debarment and Suspension (Executive Orders 12549 and 12689)—A contract award (see 2 CFR 180.220) must not be made to parties listed on the government-wide exclusions in the System for Award Management (SAM), in accordance with the OMB guidelines at 2 CFR 180 that implement Executive Orders 12549 (3 CFR part 1986 Comp., p. 189) and 12689 (3 CFR part 1989 Comp., p. 235), “Debarment and Suspension.” SAM Exclusions contains the names of parties debarred, suspended, or otherwise excluded by agencies, as well as parties declared ineligible under statutory or regulatory authority other than Executive Order 12549.
  • The recipient, sub awardee, or contractor, at any tier, or their employees, labor recruiters, brokers or other agents, must not engage in:
  • (1) Trafficking in persons (as defined in the Protocol to Prevent, Suppress, and Punish Trafficking in Persons, especially Women and Children, supplementing the UN Convention against Transnational Organized Crime) during the period of this award;
  • (2) Procurement of a commercial sex act during the period of this award;
  • (3) Use of forced labor in the performance of this award;
  • (4) Acts that directly support or advance trafficking in persons, including the following acts: i. Destroying, concealing, confiscating, or otherwise denying an employee access to that employee's identity or immigration documents; ii. Failing to provide return transportation or pay for return transportation costs to an employee from a country outside the United States to the country from which the employee was recruited upon the end of employment if requested by the employee, unless: a) exempted from the requirement to provide or pay for such return transportation by USAID under this award; or b) the employee is a victim of human trafficking seeking victim services or legal redress in the country of employment or a witness in a human trafficking enforcement action; iii. Soliciting a person for the purpose of employment, or offering employment, by means of materially false or fraudulent pretenses, representations, or promises regarding that employment; iv. Charging employees recruitment fees; or v. Providing or arranging housing that fails to meet the host country housing and safety standards.
